NIKAI Web Store – Terms and Conditions

Welcome to the NIKAI web store (“Store”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website and the purchase of products from NIKAI. By accessing or using our Store, you agree to be bound by these Terms.

1. General Use

You agree to use this website only for lawful purposes and in accordance with these Terms. You must not use the Store in any way that may impair its functionality, interfere with other users, or violate any applicable laws or regulations in Canada.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

2. Eligibility

By using this Store, you confirm that you are:

3. Products and Descriptions

We make reasonable efforts to ensure that all product descriptions, images, and specifications are accurate. However:

  • Products may vary slightly from images shown

  • We do not guarantee that descriptions are error-free, complete, or current

Many NIKAI products are DIY, aftermarket, or downloadable designs intended for technically competent users.

4. Intended Use and User Responsibility

NIKAI products are designed for general, lawful applications and are sold for responsible use only.

By purchasing or using any product, you agree that:

  • You are solely responsible for how the product is manufactured, assembled, modified, or used

  • You will use all products in compliance with applicable federal, provincial, and local laws in Canada and your jurisdiction

  • You understand that improper use, installation, or modification may result in damage, injury, or legal consequences

NIKAI does not provide legal advice and makes no representations regarding the legality of any specific use case.

5. DIY Fabrication and Technical Disclaimer

Many NIKAI products require user fabrication (e.g., 3D printing, machining, or assembly).

You acknowledge and agree that:

  • Final product performance depends on materials, printer settings, tolerances, and user skill

  • Improper fabrication may result in structural failure, malfunction, or unsafe conditions

  • You are responsible for selecting appropriate materials (e.g., PETG, ABS, Nylon, TPU where specified) and validating part integrity before use

All designs, files, and instructions are provided “as-is” for informational and experimental purposes.

6. Pricing and Payment

All prices are listed in Canadian Dollars (CAD) unless otherwise stated.

We reserve the right to:

  • Change prices at any time without notice

  • Correct pricing errors, even after an order is placed

Payments must be completed at checkout using approved payment methods. Orders will not be processed until payment is received.

7. Shipping and Delivery

  • Shipping times are estimates and not guaranteed

  • We are not responsible for delays caused by carriers, customs, or external factors

  • Risk of loss transfers to you upon shipment

You are responsible for ensuring that shipping information is accurate.

8. Digital Products

For downloadable products:

  • All sales are final once the file has been accessed or downloaded

  • Files are provided “as-is” with support provided at our discretion

  • You are responsible for ensuring compatibility with your equipment and materials

9. Returns and Refunds

Physical Products

We accept returns under the following conditions:

  • Request is made within 14 days of delivery

  • Item is unused and in original condition

Shipping costs are non-refundable unless the product is defective.

Digital Products

Due to the nature of digital goods, no refunds are provided once delivered.

10. Intellectual Property

All content, including product designs, text, graphics, and branding, is the property of NIKAI and is protected under Canadian and international copyright laws.

You may not:

  • Reproduce, distribute, or resell digital products

  • Use designs for commercial purposes without written permission

11. Limitation of Liability

To the fullest extent permitted under Canadian law:

  • NIKAI shall not be liable for any indirect, incidental, consequential, or special damages

  • This includes, but is not limited to, damages arising from product misuse, improper fabrication, or failure during use

  • Products are provided “as-is” without warranties, except where required by law

You assume full responsibility and risk for the use, fabrication, and application of all products.

12. Indemnification

You agree to indemnify, defend, and hold harmless NIKAI and its owners, affiliates, and representatives from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of products

  • Your violation of these Terms

  • Your failure to comply with applicable laws or regulations

13. Privacy

Your use of the Store is also governed by our Privacy Policy. By using the Store, you consent to the collection and use of your information in accordance with that policy.

14. Modifications

We reserve the right to update or modify these Terms at any time. Continued use of the Store after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.
